Trademark registration in India: timeline, cost and common mistakes

RegisterEasy Editorial Team · Updated 11 Oct 2026 · 2 min read

A practical overview of trademark clearance and filing in India, including class selection, similar marks, objections, opposition and why published timelines are estimates.

A trademark application is a legal filing, not a guarantee that a name is available or will register. Search and filing decisions should account for the mark, the goods or services, existing rights and the evidence that may be needed if an objection or opposition arises.

Search the mark and similar variations

Search the official IP India register for identical and similar word marks, phonetic equivalents and relevant device marks. Search should not stop at an exact spelling: consumers may hear, read or remember a mark differently. Review the status and goods or services listed for potentially relevant records.

An online search is an initial screening exercise, not a legal opinion or clearance guarantee. Search results can be incomplete, status can change, and unregistered rights or other laws may still matter.

Choose the correct goods and services

Trademark applications are classified by the goods or services for which protection is sought. Describe the real and planned business activity accurately, then identify the relevant class or classes using the official classification resources. A class number alone does not define the entire scope of protection.

Avoid selecting classes solely to make an application look broader. An inaccurate specification can create examination issues or leave important products and services uncovered.

Understand filing, examination and opposition

After filing, an application may be examined and an examination report may require a response. If accepted, it may be published, allowing opposition within the applicable period. A registration certificate is issued only after the statutory process is completed and any issues are resolved.

Processing time varies with workload, objections, hearings, oppositions and the applicant’s response. A filing receipt is not a registration certificate. Use the ™ symbol responsibly for a claimed mark; reserve ® for a mark that is registered.

Common avoidable mistakes

  • Filing before searching similar marks and spelling variations.
  • Choosing a mark that describes the goods or services too directly without checking distinctiveness.
  • Using a goods/services description that does not match the actual business.
  • Ignoring examination notices, publication or opposition deadlines.
  • Assuming a search result or application number guarantees registration.

Frequently asked questions

Does an online trademark search confirm that a brand is available?

No. It can identify records to review, but it is not a legal clearance opinion or guarantee of acceptance.

How long does trademark registration take?

There is no fixed guaranteed duration. Timing depends on examination, objections, hearings, opposition and current registry processing.

Can I use the registered symbol after filing?

No. The ® symbol should be used only for a registered mark. Filing alone does not mean registration has been granted.
