Step-by-step trademark filing process

RegisterEasy Editorial Team · Updated 11 Oct 2026 · 1 min read

A clear map of the trademark application stages, with reminders that search results and filing receipts do not guarantee registration.

Trademark applications move through examination and publication stages, and some receive objections or opposition. The Registry decides applications under the current Trade Marks Act, rules and examination practice.

Steps

  1. Define the mark and business scope

Decide whether the application covers a word, logo or other mark and describe the genuine goods or services for which protection is sought.

  2. Search for similar marks

Search exact and similar spellings, phonetic equivalents and relevant classes using official IP India resources. Treat the search as screening, not legal clearance.

  3. Prepare and file the application

Enter applicant, mark and goods or services details accurately, submit the current application form and pay the applicable filing fee.

  4. Monitor examination

Review the Registry status and any examination report. If a response or hearing is required, note the official deadline and obtain appropriate advice.

  5. Track publication and possible opposition

If accepted for publication, monitor the Trade Marks Journal and respond to any opposition within the applicable statutory process.

  6. Use the correct status and symbols

A filing acknowledgement is not a registration. Use ™ appropriately for a claimed mark and use ® only after registration is granted.

Is there one fixed trademark registration timeline?

No. The time varies by examination, response, hearing, opposition and Registry workload.
